Rental Agreement
Please read your vacation rental agreement carefully before you begin your vacation.
 
Any monies received by VIP Vacation Services for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.
CHECK-IN, CHECK-OUT:
Check-In time:               4:00 PM
Check-out time:         10:00 AM
Early check-in and late check-out may be possible upon request for a small fee. Check with your concierge at least 24 hours prior.
Please be aware of the check-in/check-out time. Unapproved early check-ins and late check-outs will be charged $20 fee for each 30 minutes before check-in time or after check-out time.
 
PAYMENT TERMS & CANCELLATION: A booking deposit is required at time of booking with 100% of the balance of the reservation fees plus the Refundable Security Deposit due 30 days prior to your check-in date. Please note there is a $50 cancellation fee that applies to all cancellations or date changes made after booking.
Cancellations made 30 days or more prior to the check in date will receive 100% refund less the cancellation fee. Cancellations made 15-30 days prior to arrival will receive 50% refund less the cancellation fee. There are no refunds for cancellations made within 14 days of arrival.
For your security and convenience, we only accept credit or debit card payments. We do not accept checks, cash, Zelle, Venmo, or other forms of payment, nor will we ask for payment that way. We will always direct you through our secure direct portal for updating payment information.
 
HOUSE RULES: All Guests agree to abide by the terms set forth in this Agreement, all County Regulations, ( http://www.archuletacounty.org/247/Land-Use-Regulations ) the House and Community Rules found in the Guest Information Binder found in each home, as well as any requests of the Owner or Managers during your stay in the Home. No commercial activities are allowed on the premises at any time, and no signs, structures or banners shall be erected or displayed. Each Home may have specific rules regarding large groups, parties, pets, smoking, etc. These rules are detailed in the Property Description section of each online marketing and are incorporated in this Rental Agreement. Please review these terms carefully, as violation may result in additional fees or eviction without refund.
 
OCCUPANCY: Only the maximum number of people specifically registered with VIP and final payment shall occupy the premises as overnight Guests. Children over 24 months are counted in total occupancy. Daytime visitors, other than guests, are allowed without any additional charge. Visitors shall never be allowed on any property without Guests present. Guests are 100% responsible for any damage caused by visitors.
 
IMPORTANT MAXIMUM OCCUPANCY: It is important that you understand that the County of Archuleta Vacation Rental Permit issued to this home allows for a maximum of {reservations.unit_max_occupants} as advertised. VIP will be in contact with you to confirm the number of guests you plan to bring and to make sure you are in compliance with the county regulations. Should you bring more guests than are permitted, you will be found in violation of Archuleta County Land Use Regulations and subject to eviction with no refund of money, and up to a $1000 fine. We take this very seriously.
 
REFUNDABLE DAMAGE DEPOSIT: A Refundable Damage Deposit will be applied to actual damages caused by Guests or Visitors of Guests, excess cleaning services, fines imposed or costs of enforcing this Agreement. Guest understands that the cost of repairing any damage may exceed the amount of the deposit and agrees to pay, within 30 days, any amount due that exceeds the amount of the deposit. If there is no damage to property, the deposit refund shall be processed within 5 days of departure. If damage did occur, within 30 days following the end of the reservation, the security deposit will be applied, accounted for or fully or partially refunded to the Guest. If the Guest has provided a credit card, the Guest hereby authorizes VIP to charge these expenses to his/her account. Guests shall report any damage noted upon arrival to avoid any security deposit losses. Notwithstanding anything to the contrary contained herein, Guest’s liability shall not be limited to the security deposit. Refunds may take up to 5 days from the date VIP requests the refund.
 
HOUSEHOLD SUPPLIES: Owners will provide a supply of liquid hand soap in each bathroom and kitchen, hand lotion, dishwashing detergent and laundry detergent. Properties will have an initial supply of paper towels, toilet paper and kitchen garbage bags. If you feel you may need more, please add these to your supply list. Additionally, a variety of spices and cooking ingredients are generally available for Guest’s use. Kitchen appliances and cooking tools will be noted in each Listing. Please contact us should you have any specific needs, and we will confirm if it is available. Clean linens for each bed and bath towels (1 large bath towel for each Guest and 1 hand towels per sink). Please let us know before your arrival if you would like more towels in your home. Remember, there are laundry facilities in the home and plenty of laundry soap.
 
NOT INCLUDED: Not included in this Rental Agreement is daily maid service, household supplies, baggage handling, pay per view charges, auto rental, food, liquor, laundry, personal items, excessive wear and tear, or excessive cleaning upon departure (i.e. stained or soiled cushions, upholstery, carpet shampooing, etc.).
 
CHILDREN: Many homes are NOT CHILD PROOF and require young children to be properly supervised. Severe injury or death could result from failure to properly supervise your children. Additionally, children are not to play on the decks or loft railings, stairways or any of the furnishings. The Guest alone is responsible for child safety.
 
HOUSE PARTIES OR EVENTS: There shall not be any “house parties” or “events” on the Premises. Celebrations (birthday, anniversary or similar) are allowed as long as occupancy rules are followed.
 
DISTURBANCES: Guest acknowledges that each property may be a part of a quiet peaceful community and agrees to be highly considerate of the neighbors. The premises shall not be used in such a manner as to generate noise (including loud music, loud vehicles running, etc.) which will disturb neighbors, nor will neighbors be harassed or bothered in any manner. Guest understands that many homes do not have fencing and that Guest agrees not to cross through neighbor yards. Management requests that all Guests begin the quieting process at 8 PM and understand and agree that absolute quiet time begins at 10:00 PM until 7:00 AM daily. Guest agrees to pay any fines associated with disturbance of the neighbors as imposed by the authorities or Home Owner Associations.
 
NO SMOKING: Smoking of any kind is strictly prohibited anywhere in any home. Homes may allow for smoking outside. It is important to read the Guest Information Binder for guidance on smoking outside. Disposing of cigarette butts anywhere on the property is strictly prohibited. Any violation of the smoking rules is grounds for loss of damage deposit plus additional fees for cleaning.

PETS: If the home associated with this Rental Agreement is a Pet Friendly Home, you may be allowed to bring your pets with an additional paid fee of $75 per pet (dogs only, maximum 2), plus an additional $100 refundable security deposit per pet. If you plan to bring a pet, you must initial below.  The Pet Addendum should be emailed shortly after this Agreement. Failure to inform Management of bringing pets will result in a fine of up to $500 per pet or possible eviction. All changes to the number of pets must be provided to Management prior to arrival. A separate Pet Addendum will be sent to all Guests who book with Pets.
 
MOUNTAIN TRAVEL / ANIMAL NOTICE: The home you have rented is in the mountains at an elevation above 7,000 feet. If you have any medical issues, please consult a medical professional if you have any medical issues or are concerned about the elevation. Pagosa Springs is home to many animals and wildlife including deer, elk, fox, coyote, bear, mountain lions, bobcats, skunks, racoons, mice, bats, birds, squirrels, chipmunks, or other animals. Please be aware that VIP takes all reasonable care to prevent critters from entering a home. With that said, from time to time, any animal may enter a home if a door is left open and mice can enter a home through the smallest cracks. Please make sure all doors are kept always shut and please notify us if any critter enters the home.
 
VEHICLES / PARKING: The home you rented can accommodate [Custom field 2] vehicles which can be safely parked in the driveway or parking area of this home as approved by Archuleta County. Some homes have additional parking. Please inquire if parking is a concern. Parking is prohibited on any street. Guests are solely responsible for their own vehicles, including being stuck in snow, damage caused by slipping on ice, snow or mud. Guests are responsible for the cost of towing or removing a vehicle due to mud or snow. All trailers, RV's, Campers or other recreation vehicles ("Other Vehicles") must be approved prior to arrival to be allowed on premises. Guests assumes full responsibility and cost to store non-approved Other Vehicles off site during stay at the home. To obtain an approval, please email [email protected] with full description including dimensions of any Other Vehicle, along with a description of all vehicles so we can best assist you in this matter.

LOCKED OWNER’S CLOSETS: It is expressly agreed that the locked closets are private and for the sole use of the owners. These areas are NOT included in this Agreement.
 
WEAR & TEAR: Guest agrees to maintain the premises in the same condition as found at arrival and will not allow any damage, waste, misuse or neglect. Should any damage, waste, misuse or neglect occur on the property, it will be the sole responsibility of the Guest and Guest agrees to promptly pay the reasonable costs thereof.
 
FURNISHINGS: Guest agrees not to move or alter any of the furnishings and shall use them only for the purposes intended. A fee (with a minimum of $35) to return furniture will be deducted from the Damage Deposit for the cost of returning any moved furniture or furnishings. Guest shall respect and protect all furnishing and décor and understands that many of the furnishings are unique and valuable. Guests shall be solely responsible for the replacement value of any damaged or destroyed furnishings on the property.
 
MAINTENANCE:  VIP cares very much about the home and strives to keep it in excellent shape. If you notice any problems or maintenance issues, please notify VIP immediately.
 
GUEST’S PERSONAL PROPERTY: Guest’s personal property and effects are the sole responsibility of the Guest. Owner’s insurance will not cover your personal property and Owner will not be liable for any loss or damage due to theft, or loss of such personal property arising from any acts or negligence of any other person, or from any cause whatsoever, nor shall the owner be liable for any injury to the Guest or other person in or about the premises. All personal property found in home will only be held for 30 days.
 
INSURANCE FOR TRAVEL DISRUPTION: Guest agrees that Owners or Management shall not be liable for travel disruptions caused by any reason, including inclement weather, Guests' personal property, illness or injury. Guests are strongly encouraged to purchase a Travel Insurance Policy through the online booking system or contact VIP for any questions.
 
INDEMNIFICATION AND HOLD HARMLESS:  While VIP Vacation Services and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. VIP Vacation Services and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. VIP Vacation Services and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify VIP Vacation Services and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
 
MANAGEMENT OR OWNER ACCESS:  If requested, you agree to allow VIP or Owner to access the property during your stay with a 24 hour notice. Your manager shall exercise this right of access in a reasonable manner.
 
ASSIGNMENT: This Agreement may not be assigned, or any portion of the premises sublet. Any attempt to do so shall be considered a material breach of this contract.
 
CHANGES: The parties hereto further agree that any changes to this agreement shall be in writing to be enforceable or otherwise considered null and void.
